1. Agreement to these terms

These Terms of Use (“Terms”) govern your use of the Retro Nes Emulator app for Android and this website. By installing or using Retro Nes Emulator you agree to them. If you do not agree, please do not use the app.

Please also read our Privacy Policy, which explains what the app stores and which network requests it makes.

2. What Retro Nes Emulator is

Retro Nes Emulator is an emulator: software that lets your phone run games written for the Nintendo Entertainment System (NES). It includes:

• a built-in list of games (the catalog) with names, cover pictures and preview clips;
• a downloader that fetches the game file you choose onto your phone;
• a library, a player with touch and controller input, and save features.

Retro Nes Emulator does not include any game. A game file exists on your phone only if you tap Download for it. The catalog is a listing; it does not grant any right to a game.

3. Games and your responsibility

Games, their code, artwork, music and names are protected by copyright and other laws, and are owned by their publishers and creators. Whether you may download or play a particular game depends on the law where you live and on your rights to that game.

You are solely responsible for making sure you are legally entitled to download, store and play every game you use with Retro Nes Emulator, and for following the copyright rules that apply to you. We do not license, sell or vouch for any game, and nothing in the app is legal advice.

4. Acceptable use

When using Retro Nes Emulator you agree not to:

• use it to infringe anyone's copyright or other rights, or to distribute games you have no right to share;
• copy, resell or redistribute game files you download, or share them publicly;
• interfere with, overload or attack the servers the app connects to, or the app itself;
• reverse-engineer or modify the app to remove its protections or to misuse third-party services, except where the law or an open-source license expressly allows it;
• use the app, the website or the name Retro Nes Emulator in a way that suggests a connection with Nintendo or any game publisher.

5. Third-party content and availability

Cover pictures, preview clips and game files are served by a third-party content server that we do not control (see the Privacy Policy). It may change, move, slow down or disappear at any time. As a result:

• a cover, clip or download may be unavailable, out of date or removed without notice;
• we cannot guarantee that any particular game can be downloaded, now or later;
• we are not responsible for that server's content, availability or practices.

Games you have already downloaded are stored on your phone and keep working without any connection.

6. Open-source and third-party software

Retro Nes Emulator includes the EmulatorJS emulator front end, the FCEUMM NES emulation core, and typefaces, each provided under its own license. Those licenses apply to those components and are reproduced, with credits, in the notices included with the app. Nothing in these Terms limits your rights under those licenses.

7. Trademarks and ownership

NES, Nintendo Entertainment System and Nintendo are trademarks of Nintendo Co., Ltd. Retro Nes Emulator is an independent project. It is not affiliated with, endorsed by or sponsored by Nintendo or any game publisher, and all game names and artwork belong to their owners.

The Retro Nes Emulator name, logo and the app's own design and text are the property of the Retro Nes Emulator project. You may use the app for your personal, non-commercial use as these Terms allow, but you receive no other rights to them.

8. Your saves and data

Saves, settings and downloaded games live only on your device. There is no cloud copy and Android's app backup is turned off, so uninstalling the app, clearing its data or losing your phone removes them. You are responsible for the device and for anything you want to keep.

9. Updates and changes to the app

We may update, change or stop offering Retro Nes Emulator or any of its features at any time, for example to fix problems, to follow the law, or if a content source stops working. We will try to describe significant changes in the release notes, but we are not obliged to provide updates or support.

10. No warranty

Retro Nes Emulator is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy, non-infringement, or that the app will be uninterrupted, error-free or compatible with every device or game. Emulation is not perfect: some games may run imperfectly or not at all. Some laws do not allow these exclusions, in which case they apply only to the extent the law permits.

11. Limitation of liability

To the fullest extent the law allows, the Retro Nes Emulator project and its contributors are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost data, lost saves, lost profits or device problems, arising from your use of, or inability to use, the app or website, even if we were told such losses were possible. Because Retro Nes Emulator is free, our total liability for any claim relating to it is limited, to the extent the law allows, to the amount you paid for it, which is zero. Nothing in these Terms limits liability that cannot be limited by law.

12. Ending your use

You can stop using Retro Nes Emulator at any time by uninstalling it. We may withdraw the app or block misuse of it if you break these Terms or the law. Sections that by their nature should survive (such as ownership, warranty and liability) continue after you stop using the app.

13. Notices from rights holders

If you own rights in a game, artwork or other material and believe it is being made available in a way that infringes them, please tell us which material it is, how you own the rights, and how we can reach you, and we will review it promptly and act where appropriate, including by removing the item from the catalog.

A public contact address for rights-holder notices will be listed here when the first release is published.

14. Changes to these Terms

We may update these Terms from time to time. The date at the top shows when they last changed. If you keep using Retro Nes Emulator after an update, you accept the new Terms. If a change is significant, we will say so in the release notes.

15. Governing law

These Terms are governed by the laws of the place where the Retro Nes Emulator project is based, without regard to its conflict-of-law rules, except that any mandatory consumer-protection rights you have where you live still apply.
